The plaintiff was a 59-year-old woman from Jersey City who was a passenger in a vehicle that was t-boned by another driver who negligently ran a stop sign. As a result of the crash, the plaintiff aggravated a pre-existing cervical spine condition. Although MRIs taken after the accident showed minimal changes when compared to MRIs taken before the accident, the plaintiff’s symptoms required her to undergo a cervical discectomy and fusion. Following her surgery, the plaintiff never returned back to work as a registered nurse. After years of litigation, the case settled shortly before trial for $1 million at a mediation with Retired Judge Hon. Mark B. Epstein. Alex Capozzi, Associate on the Brach Eichler Personal Injury team, represented the plaintiff.
